Voted. In Heller the supreme court decided individuals did have the right as well (at least in D.C.)
I was reading up on constitutional issues the other day and found out something I did not realize. With regard to the Heller case the supreme court didn't just decide that the second amendment applied to individuals, they decided that the right of individuals to carry arms was not granted by the second amendment, it is a preexisting human right that there is no need for the constitution to affirm or establish. In the early days of the U.S. the courts never maintained that states were bound by the constitution. Since then the 14th amendment and various court findings have implied that parts of the constitution did indeed bind the states, however a decision has not been made regarding the binding of the states to comply with the second amendment. If the Heller case established that the right to bear is a preexisting right that requires no constitutional validation I believe that it would apply to basically everybody alive. Maybe Hoosierbuck can correct me if this is not right.
